Divorce

A Divorce Order legally ends a marriage. It does not deal with arrangements for property, finances, child support or children, which are dealt with separately.

Under Australia’s no fault divorce system, the Court does not take into account who was at fault or why the relationship ended. A party to a marriage can seek a divorce on the basis that the marriage has broken down irretrievably and can file an application for divorce 12 months after separation occurred. A Divorce Order can be made by the Family Court of Western Australia provided that all legislative and procedural requirements set out in the Family Law Act 1975 (Cth) and Family Court Rules 2021 (WA) have been satisfied.

We assist clients with respect to all matters related to divorce including:

a) lodging divorce applications and ensuring that all legal and procedural requirements are satisfied in order for a Divorce Order to be made;

b) providing advice to clients who have been served with a divorce application; and

c) attending Divorce Hearings.

We offer affordable fixed fee packages for divorce applications regardless of whether it is a joint application (filed by both parties to the marriage) or a sole application (lodged by only one party to the marriage).

Obtaining a Divorce Order is an important legal step that should not be overlooked when a marriage has ended and there are no prospects of reconciliation. Not obtaining a Divorce Order or delaying an application to obtain one, can create significant legal and financial risks for clients.

If you require legal assistance with obtaining a Divorce Order or any matters related to divorce, send an enquiry to Rezolve Legal and we will guide you through the process and outline our fixed fee packages.
